Terms and Conditions of Use

Introduction
These terms apply when you use BerdSend for airtime, mobile Bundles/plans, scheduled/Subscription recharges, customer accounts, promo balance and the referral program. BerdSend does not currently offer person-to-person money transfer, remittance, cash pickup or banking services. By using the service, you agree to these terms.
1. Acceptance of Terms
By accessing or using BerdSend, you agree to these terms together with our Privacy Policy. If you do not agree, do not use the service.
2. Mobile Top-up Service
BerdSend provides international mobile top-up services. Customers select the destination country, mobile operator and recipient number, then enter an airtime amount or choose an available Bundle/plan. For fixed Bundles/plans, denominations and plan details are based on information supplied by the top-up provider and may vary by operator and country.
3. Accuracy of Transaction Information
You are responsible for verifying the destination country, operator, recipient phone number and amount before payment. Once a mobile operator confirms a top-up as successfully delivered, it may not be possible to cancel, refund or move the credit to another number.
4. Recipient Amount and Conversion
For airtime, the “Recipient gets” amount may be based on operator information, local currency and conversion rates available at the time of the transaction. For a fixed Bundle/plan, BerdSend submits the denomination selected by the customer according to provider data; the customer price may include BerdSend service pricing and applicable currency conversion. Amounts, rates, plans and included benefits may change according to the operator or provider.
5. Payments
Payments are processed through supported payment providers. For applicable USD transactions, BerdSend uses Square; for applicable BRL transactions, BerdSend uses Mercado Pago. Available payment methods and currency depend on where the customer is paying from and the transaction configuration, not only on the recipient country.
6. Customer Accounts
When guest checkout is available, a top-up may be made without an account. A BerdSend account may provide access to transaction history and status, promo/bonus balance, referral code and Subscription management. On compatible devices, BerdSend may support biometric login such as fingerprint or Face Unlock. You are responsible for protecting your password, device and other login information.
7. Referral and Bonus Program
The BerdSend referral/bonus program is available in the app where supported. Referral/promo codes are used at signup. When a new customer signs up with a valid code and successfully verifies their email, the referrer may receive the applicable referral bonus. The newly referred customer does not automatically receive the same bonus. A referral code does not automatically discount top-up transactions. BerdSend may reject, delay, correct or cancel a bonus in cases of error, duplication, fraud, abuse or misuse of the system.
8. Promo Balance
If you have eligible promo balance, you may use it to pay for an eligible transaction when the balance is sufficient to cover the full payment amount. In the current version, BerdSend does not combine a partial promo balance with a card payment on the same transaction. The balance may be reserved while the transaction is processing and returned to your account if the transaction does not complete or the top-up fails, according to the transaction status. Promo balance is maintained in the applicable USD or BRL wallet for the account and is not withdrawable cash unless BerdSend expressly states otherwise.
9. Pending or Failed Transactions
If a transaction remains Pending or you notice a problem after payment, do not immediately make a second payment. Contact support with the transaction reference. If payment was validated but the top-up was not delivered, BerdSend will verify the payment and top-up provider status to determine the appropriate action, such as waiting for confirmation, retrying or processing a refund when applicable.
10. Refunds
Successfully delivered top-ups are generally non-refundable. If a payment was completed but the top-up was not delivered, any refund depends on transaction verification and the payment provider’s rules. After an approved refund is submitted, the customer’s bank or card issuer may take several business days to post the funds.
11. Third-party Providers
BerdSend uses third-party services to process payments and top-ups, including Square, Mercado Pago and Reloadly. Availability, delays, limits, rates and certain transaction outcomes may depend on those services. BerdSend does not control every outage or delay caused directly by third-party providers.
12. Prohibited Use
You may not use BerdSend for fraud, unauthorized access, bonus exploitation, fake transactions, repeated misuse of balance or referral codes, or any unlawful activity. BerdSend may limit or suspend access when there are signs of abuse or security risk.
13. Service Availability
We work to keep the service available, but we do not guarantee uninterrupted operation. Maintenance, operator outages, network delays or payment-provider issues may occur. We may modify, add or remove features when necessary.
14. Limitation of Liability
To the extent permitted by law, BerdSend is not responsible for losses caused by incorrect information entered by the customer, operator delays, network outages, bank blocks, payment-provider decisions or other events outside BerdSend’s direct control. This does not remove any rights you may have under applicable law.
15. Changes to These Terms
BerdSend may update these terms when services, features, technology or legal obligations change. The date at the top of the page shows the latest update. Continued use after an update may be subject to the revised terms as permitted by applicable law.
16. Governing Law and Contact
These terms are subject to applicable law based on the jurisdiction relevant to the transaction or service. For questions, claims or assistance, use the BerdSend Contact page.
17. Subscription / Automatic Recharges
When you create a Subscription, you authorize BerdSend and the applicable payment provider to process recurring payments for the beneficiary, amount and frequency you selected. Available frequencies may include every 7 days, every 15 days or every 30 days. The first recharge may begin processing on the same day the Subscription is activated, and later recharges follow the stored schedule. BerdSend does not store your full card number or CVV for Subscription payments; recurring charges use a saved payment method or provider token. A recharge is sent only after the corresponding payment is validated. If the payment fails, the recharge should not be sent. You may pause, resume or cancel a Subscription from your account. When a paused Subscription is resumed, the next recharge date may be recalculated from the resume date according to the selected frequency. Cancellation stops future automatic recharges; however, a payment or recharge that had already started processing before cancellation may still complete. Successfully delivered recharges remain subject to the refund rules in these Terms.
