Introduction

BerdSend respects the privacy of its customers. This policy explains the types of information we may process when you use the service, why we use it, and how we protect it.

Scope of This Policy

At this stage, BerdSend provides international mobile top-up and scheduled/Subscription recharge services. BerdSend does not currently offer person-to-person money transfer, remittance, cash pickup, or banking services. This policy applies only to BerdSend services that are currently available.

Bases for Processing

We process information when necessary to provide a service you request, manage your account, process payments and top-ups, prevent fraud, protect the service, comply with legal obligations, or with your consent where consent is required by applicable law.

1. Information We May Collect

Depending on how you use BerdSend, we may process information you provide when creating or using an account, such as your email address and other requested profile information; recipient phone number, country, operator, top-up amount, transaction details and order references; promo-code, referral and promo-balance information; and technical information such as IP address, browser, device, language and session data needed for security and service operation.

2. Payment Data

Payments are processed through payment providers such as Square or Mercado Pago depending on the applicable country and payment currency. BerdSend does not need to store your full card number, CVV or other sensitive card data on its server. Payment providers may process information required to authorize, verify or refund a payment under their own policies.

3. Top-up Data and Service Providers

To deliver a mobile top-up, BerdSend may send the information required for the transaction to a top-up provider such as Reloadly, for example the recipient phone number, operator, destination country, recharge amount and transaction reference. We limit this sharing to information needed to process and verify the service.

4. How We Use Information

We may use information to create and manage accounts, process top-ups and payments, display transaction history, manage promo balance and referral features, prevent fraud or abuse, verify transactions, provide customer support, improve the service, and comply with applicable legal or regulatory obligations.

5. Bonus and Referral Program

When a new customer signs up in the BerdSend app with a valid referral/promo code and successfully verifies their email, the system may record the referral relationship so the referrer can receive the applicable bonus. The newly referred customer does not automatically receive the same referral bonus. Bonus, ledger and referral records may be retained to prevent duplicate credits, resolve disputes and audit transactions.

6. Promo Balance

If you use promo balance on an eligible transaction, the system may reserve the balance required to cover the full payment while the transaction is processing. In the current version, BerdSend does not combine a partial promo balance with a card payment on the same transaction. Promo balance may be maintained in the applicable USD or BRL wallet for the account. We keep records of reservations, use, returns and corrections to protect account accuracy and prevent duplicate use.

7. Cookies, Sessions and Local Storage

BerdSend may use cookies, PHP sessions and browser local storage to keep you signed in, remember your language choice, temporarily preserve form information or improve your experience. You may clear these items in your browser, but some features may stop working normally.

8. Sharing of Information

We do not sell your personal information. We may share limited information with providers required to operate the service, including payment processors, top-up providers, hosting or technical services, or when required by law. Each provider may have its own privacy and data-protection practices.

9. Security

We use reasonable technical and organizational safeguards, including access controls, sessions, transaction verification and encrypted connections where applicable. However, no online system can guarantee absolute security.

10. Data Retention

We retain information only for as long as reasonably necessary to provide the service, maintain transaction records, resolve disputes, prevent fraud, meet accounting or legal obligations, and protect BerdSend and its customers.

11. Your Rights and Choices

Depending on where you live and applicable law, you may have rights to request access to, correction of, or deletion of certain personal information, or to ask how your information is used. Some transaction or security records may need to be retained where required by law or legitimate operational needs.

If you have questions about privacy, data security or a transaction, use the BerdSend Contact page. Never send your password, PIN, CVV or full card number in a support message.

13. Subscription and Recurring Payment Data

When you create or manage a Subscription, BerdSend may process and retain information required for automatic recharges, including the beneficiary, phone number, country and operator, amount, payment currency, frequency, Subscription status, next recharge date, run history and technical identifiers from the payment provider. For recurring payments, we may retain a payment-method identifier, customer ID, card ID or provider token from Square, Mercado Pago or another supported provider, together with limited card metadata such as brand or last digits when supplied by the provider. BerdSend does not need to store your full card number or CVV. This information is used to process scheduled payments, verify payment status, send a recharge only after payment is validated, prevent duplicate charges or top-ups, manage Pause, Resume and Cancel actions, resolve errors or disputes, and maintain security and transaction records. If you cancel a Subscription, we may still retain records of the Subscription and completed or attempted transactions for as long as needed for security, accounting, fraud prevention and legal obligations.

Children and Minors

BerdSend is not intended for children who are below the legal age to use payment or financial services in their jurisdiction. We do not knowingly seek to collect personal information from children. If we learn that a child’s information was submitted without appropriate authorization, we may take reasonable steps to delete or restrict the use of that information.

International Data Transfers

Because BerdSend uses technology, hosting, payment and top-up providers that may operate in multiple countries, some information may be processed or stored outside the country where you live. Where applicable, we use reasonable measures to limit the information shared and work with providers that maintain appropriate security and privacy safeguards.

How to Exercise Your Rights

To request access, correction, deletion, or information about your personal data, use the BerdSend Contact page and clearly identify the request. We may need to verify your identity before acting on a request in order to protect your account and information.

Material Changes and Consent

If we add a new service that materially changes how personal information is processed, such as a future money-transfer service, we may update this policy before or when that service launches and provide notice or request consent where required by applicable law.

14. Changes to This Policy

We may update this policy when our services, technology or legal requirements change. The date at the top of the page shows the latest update.
